The consumer has the right to withdraw from a contract concluded at a distance or off business premises within 14 days, without giving any reason and without additional costs, except for the costs provided for by law.

The direct costs of returning the goods are borne by the buyer, unless otherwise agreed.

For contracts for the sale of goods, the 14-day period starts from the day the goods come into the possession of the consumer or a third party designated by the consumer, other than the carrier.

The consumer exercises the right to withdraw from the contract by a statement, which can be given on the contract withdrawal form or in any other unambiguous way. The contract withdrawal form can be downloaded from our website.

The withdrawal statement is considered timely if it is sent to the trader within 14 days of the day the consumer received the goods. The withdrawal statement takes legal effect from the day it is sent to the trader.

The consumer must return the goods without delay, and no later than 14 days from the day the withdrawal form was sent.

The consumer is liable only for any diminished value of the goods resulting from handling the goods in a way that is not necessary to establish the nature, characteristics and functioning of the goods. The trader must refund all payments received from the consumer, including delivery costs, without delay, and no later than 14 days from the day the withdrawal statement is received. The trader may withhold the refund until the returned goods have been received or until the consumer has provided proof that the goods were sent, whichever comes first.

The consumer does not have the right to withdraw from the contract in the following cases:

  • Provision of services after the service has been fully performed, if performance began with the consumer's prior express consent and acknowledgement that they lose the right of withdrawal once the trader has fully performed the contract;
  • Supply of goods or services whose price depends on fluctuations in the financial market that the trader cannot control and that may occur during the withdrawal period;
  • Supply of goods made to the consumer's specifications or clearly personalized goods;
  • Supply of goods that are liable to deteriorate or have a short shelf life;
  • Supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery;
  • Supply of goods which, after delivery, are by their nature inseparably mixed with other goods;
  • Contracts where the consumer has specifically requested a visit from the trader for urgent repairs or maintenance;
  • Supply of sealed audio or video recordings or computer software that were unsealed after delivery;
  • Supply of newspapers, periodicals or magazines, except for subscription contracts;
  • Contracts concluded at a public auction;
  • Provision of accommodation other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities, if the contract provides for performance on a specific date or within a specific period;
  • Supply of digital content not supplied on a durable medium, if performance began with the consumer's prior express consent and acknowledgement that they thereby lose the right to withdraw from the contract.

Consumer rights are governed by the Law on Consumer Protection ("Official Gazette of RS", No. 88/2021).

A consumer is a natural person who buys goods or services to meet personal needs, that is, for purposes not related to their business or commercial activity.

Customers who use a product for business or commercial purposes are not considered consumers within the meaning of the above law.

Products purchased for personal use are covered by the seller's legal liability for conformity of the goods with the contract for 24 months from the date of purchase.

Products used for business or commercial purposes are covered by a manufacturer's warranty of 12 months, if so provided by the warranty terms.

The manufacturer's warranty does not affect the consumer's statutory rights regarding conformity of the goods.

How do I file a complaint?

If a product does not conform to the contract, you should contact the seller from whom it was purchased, bringing:

  • the purchased product;
  • proof of purchase (a fiscal receipt or other proof of purchase).

After receiving the complaint, the seller must:

  • issue the consumer a written confirmation of receipt of the complaint;
  • provide a response within 8 days at the latest (in writing or electronically);
  • inform the consumer whether the complaint has been accepted;
  • state how and within what time frame the complaint will be resolved.

The seller must resolve the complaint within:

  • 15 days from the date the complaint was filed;
  • 30 days for technical goods and furniture.

If, for objective reasons, the complaint cannot be resolved within the specified time frame, the seller must inform the consumer, propose a new deadline and obtain the consumer's written consent to the extension. The deadline can be extended only once.

A product conforms to the contract if it:

  • matches the description given by the seller;
  • has the properties shown in the sample or model;
  • has the properties required for a particular purpose that was known to the seller;
  • has the properties required for the normal use of products of the same type;
  • in quality and performance, matches what is usual for that type of product.

There is no liability for conformity if the defect resulted from:

  • failure to follow the instructions for use or maintenance;
  • unprofessional or careless handling of the device;
  • intervention by an unauthorized service center;
  • damage caused by electric shock, lightning strike or natural disasters.

Complaints do not cover normal wear of consumable parts such as:

  • carbon brushes;
  • bearings;
  • bulbs and lamps;
  • blades;
  • batteries;
  • cables;

Except where it is established that the defect existed at the time of purchase.

Dispute resolution

The manufacturer's warranty is a voluntary obligation of the manufacturer and does not affect the consumer's rights based on the statutory liability for conformity of the goods.
A consumer dispute can also be resolved out of court.
Out-of-court resolution of consumer disputes is carried out before a body for out-of-court dispute resolution kept by the competent ministry, in accordance with the Law on Consumer Protection.
